Terms of Service

These Terms form a binding agreement between you and Hulofton Robinson II, a sole proprietor (the "Seller", "we", "us", "our"), trading under the brand TextHerBack™ — an AI Communication Coach and Conversation Analysis Tool.

Merchant of Record. Our order process is conducted by our online reseller Paddle.com Market Ltd ("Paddle"). Paddle is the Merchant of Record for all our orders. Paddle handles all checkout, payment processing, subscription billing, sales-tax/VAT calculation and remittance, invoicing, customer service inquiries related to billing, and refunds and returns. Your purchase is therefore also subject to the Paddle Checkout Buyer Terms and the Paddle Privacy Notice.

Acceptance

By creating an account or using TextHerBack™ (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

What the Service is

TextHerBack™ is AI Communication Analysis Software. Category: Productivity Software. Subcategory: AI Communication Analysis. The Service analyzes text or screenshots the user submits and returns communication insights such as reply probability, engagement level, message quality analysis, communication coaching, and AI rewrite suggestions. It is not a dating service, matchmaking service, relationship service, relationship coaching service, pickup or seduction coaching service, adult service, social discovery platform, social-engineering tool, relationship-manipulation tool, or a substitute for professional, legal, psychological, or relationship advice.

Acceptable use

You agree not to use the Service for any of the following prohibited purposes:

  • Harassment of any person or group.
  • Stalking, surveillance, or monitoring without lawful consent.
  • Deception, including creating misleading or false communications.
  • Manipulation, coercion, or psychological exploitation of another person.
  • Impersonation of any individual or entity.
  • Fraud, scams, phishing, or financial deception of any kind.
  • Any other illegal activity under applicable law.
  • Submitting content involving minors in any sexual or romantic context.
  • Attempting to bypass rate limits, reverse engineer, scrape, or resell the Service.
  • Submitting conversations you do not have a lawful right to analyze.

Accounts

You are responsible for the security of your account and any activity under it. Notify us immediately of unauthorized use.

Subscriptions, cancellation & refunds

Paid plans renew automatically until canceled. Cancel anytime from Settings → Billing or by emailing support@textherback.app. Access continues through the end of the current billing period.

Refunds are governed by our Refund Policy — a 30-day money-back guarantee on first-time paid subscriptions.

Intellectual property

The Service, including the TextHerBack™ name, logo, software, models, prompts, designs, copy, and underlying systems, is owned by Hulofton Robinson II and protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

Your content. You retain ownership of text, screenshots, and other material you submit ("User Content"). You grant us a worldwide, royalty-free license to host, store, process, and display User Content solely to operate, secure, and improve the Service for you. We do not use your private conversations to train third-party foundation models.

AI output. Suggested replies, scores, and insights generated for you are yours to use. You are responsible for what you choose to send to other people.

Feedback. If you send us suggestions, we may use them without restriction or compensation.

Suspension and termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, abused the Service, created risk or legal exposure for us or other users, or if we are required to do so by law. Where practical, we will tell you why and give you a chance to respond.

You may stop using the Service and delete your account at any time from Settings or by emailing privacy@textherback.app. On termination, your right to use the Service ends immediately; data is handled per our Privacy Policy. Sections that by their nature should survive (IP, disclaimers, limitation of liability, indemnity) will survive termination.

Disclaimer

The Service is provided "as is." We make no warranty that any response, score, or insight will produce a particular outcome. See the full disclaimer.

Limitation of liability

To the maximum extent permitted by law, TextHerBack™ and Hulofton Robinson II are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service.

Changes

We may update these Terms. Material changes will be announced in-app or by email. Continued use after changes constitutes acceptance.
